A home inspection is not a substitute for a building inspection or a code compliance inspection, nor do home inspectors interpret or cite building codes.
When a new home is built in New Jersey, the builder is required by NJ state law to provide the new home buyers with a Home Warranty. This Home Warranty covers some areas of the home should they become defective. Each Home Warranty from different builders and from different warranty companies is different. However, NJ state law dictates the minimum warranty that can be provided. The rules and regulations are referenced in N.J.A.C 5:25-1.1 et seq. In the rules and regulations, defect definitions are detailed and means of corrections explained. As long as a particular defect meets or exceeds the defect definition it should be covered under the warranty. However, if the defect does not meet or exceed the defect definition than according to the builder and the warranty company, it is not a defect.

The first year of the warranty is an important year. During this year, the house may settle, shrink, move, or components of the house may not function as intended. These defects are known as Performance Standard Defects and are only covered during the first year of warranty. Any defect that arises during this first year should be brought to the attention of the builder prior to the expiration of the one-year period.
Prior to the expiration of the one-year warranty it is important to have Rook Home Inspections LLC, a professional home inspection company, visit the property and prepare a written report detailing those defects that may be covered by the builders' warranty. The inspection should be completed during the 10th or 11th month of the warranty to allow for adequate time for the new home owner to notify the builder in writing of any defects that they may want corrected.
